Introduction

Welcome to EmailSum, a service provided by ThisWebApp Inc. ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our email-based course delivery platform, including any content, functionality, and services offered on or through our website at emailsum.com (the "Service").

Please read these Terms carefully before using our Service. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, you may not access or use the Service.

1. Eligibility

You must be at least 13 years of age to use our Service. If you are under 16 years of age and reside in the European Economic Area, you must have parental consent to use our Service. By using our Service, you represent and warrant that you meet all eligibility requirements.

2. Account Registration

To access certain features of EmailSum, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree not to disclose your password to any third party and to notify us immediately of any unauthorized use of your account.

3. Subscription and Billing

3.1 Free Trial

We offer a one-week free trial of EmailSum. At the end of the trial period, your account will automatically convert to a paid subscription unless you cancel before the trial ends.

3.2 Subscription Plans

We offer the following subscription plans:

• Basic Plan: $8 per month
• Pro Plan: $15 per month
• Enterprise Plan: Custom pricing, requires separate contract

Subscription fees are billed in advance on a monthly basis. You authorize us to charge your designated payment method for these recurring fees.

3.3 Changes to Pricing

We reserve the right to modify our pricing at any time. We will provide notice of any price changes at least 30 days in advance.

3.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings or by contacting our customer support. If you cancel, you may continue to use EmailSum until the end of your current billing period.

We offer refunds for cancellations within the current billing month. Refunds will be processed to your original payment method.

4. User Content

4.1 Content Ownership

You retain all ownership rights to content you upload, create, or share through EmailSum ("User Content"). By uploading or creating content on our platform, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such User Content for the purpose of providing and improving our Service.

4.2 Content Restrictions

You agree not to upload, create, or share content that:

• Infringes on the intellectual property rights of others
• Violates the privacy or publicity rights of others
• Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Contains malware, viruses, or other harmful code
• Is used to impersonate others or misrepresent your affiliation with any person or entity

We reserve the right to remove any content that violates these Terms and to terminate or suspend accounts of users who repeatedly violate our policies.

5. Data Privacy and Security

7. Limitation of Liability

To the maximum extent permitted by law, ThisWebApp Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, or goodwill, resulting from your access to or use of or inability to access or use EmailSum.

8. Indemnification

You agree to indemnify, defend, and hold harmless ThisWebApp Inc. and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, and expenses, including but not limited to legal fees, arising out of or in any way connected with your access to or use of EmailSum or your violation of these Terms.

9. Termination

We may terminate or suspend your account and access to EmailSum immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes at least 30 days prior to the changes taking effect. Your continued use of EmailSum after any such changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
